Article 1: Definitions
In these terms and conditions, the following definitions apply:
1.1 Seller: J. van Dam Numismatics, located in Vlaardingen, registered in the Dutch Chamber of Commerce under number 89241738.
1.2 Buyer: Any natural person or legal entity who enters into an agreement with J. van Dam Numismatics.
1.3 Agreement: The purchase agreement between the seller and the buyer regarding the purchase of coins, medals, banknotes, and numismatically related products, whether online, at fairs, or in person.
1.4 Coins: All coins offered by J. van Dam Numismatics, including collectible coins, historical coins, and related products, as well as banknotes, medals, and numismatically related products.

Article 2: Applicability
2.1 These terms and conditions apply to all offers, agreements, deliveries, and services of J. van Dam Numismatics, regardless of the sales channel (online, at fairs, or in person).
2.2 Deviations from these terms are only binding if agreed upon in writing.
2.3 If one or more provisions in these terms are null or voidable, the remaining provisions will remain fully in force.

Article 3: Offers and Agreements
3.1 All offers and prices of J. van Dam Numismatics are non-binding and subject to availability, unless otherwise agreed in writing.
3.2 An agreement is concluded when the seller confirms the buyer’s order in writing or by email, or when the buyer completes a purchase at a fair or in person.
3.3 The seller reserves the right to refuse orders or impose additional conditions for delivery.

Article 4: Authenticity and Quality Assessment
4.1 All coins sold by J. van Dam Numismatics are guaranteed authentic unless otherwise specified. The seller guarantees the authenticity of the offered coins.
4.2 The quality of the coins indicated by J. van Dam Numismatics is a careful assessment based on the expertise, experience, and knowledge of the seller. This assessment is made to the best of the seller’s knowledge and is realistic.
4.3 Quality assessments can be subjective and are considered the seller’s opinion. The buyer has the opportunity to assess the quality of the coins based on the provided images and descriptions before making a purchase.
4.4 The buyer’s right to assess the quality of the coins themselves takes precedence. The images and product descriptions are considered decisive, unless otherwise agreed in writing.

Article 5: Prices and Payments
5.1 All prices are stated in euros and include VAT unless otherwise stated.
5.2 Payment must be made in advance for online purchases. For purchases at fairs or in person, payment can be made on-site.
5.3 J. van Dam Numismatics accepts payments by bank transfer, cash, or other payment methods offered by the seller.
5.4 In case of late payment, the buyer is in default by operation of law, and the seller is entitled to claim interest and collection costs according to the statutory interest rate.

Article 6: VAT and Margin Scheme
6.1 The sale of coins by J. van Dam Numismatics falls under the margin scheme in accordance with Article 28c;d of the Dutch Turnover Tax Act 1968. This means that no VAT is stated on the invoice for products falling under this scheme.
6.2 Investment gold is exempt from VAT under Articles 28j to m of the Dutch Turnover Tax Act 1968. No VAT is due for gold that meets the definition of investment gold, and this will not be separately stated on the invoice.

Article 7: Delivery and Shipping
7.1 Delivery takes place at the address provided by the buyer for online purchases, or at the location of purchase during fairs or in-person transactions.
7.2 Shipping is at the buyer's risk unless otherwise agreed. The seller will ensure proper packaging, if possible.
7.3 The stated delivery times are indicative, and exceeding a delivery time does not entitle the buyer to compensation or termination of the agreement unless expressly agreed otherwise.
7.4 J. van Dam Numismatics is not liable for delays or loss caused by third parties (e.g., postal services).

Article 8: Right of Withdrawal (for Consumers)
8.1 In the case of online purchases, the consumer has the right to cancel the agreement within 14 days after receiving the product without giving any reason (right of withdrawal).
8.2 To exercise the right of withdrawal, the buyer must inform the seller in writing or by email. The product must be returned in its original condition, without defects that were not visible before or during the sale.
8.3 The costs of return shipment are borne by the buyer, unless otherwise agreed.
8.4 Upon proper receipt of the returned item, the seller will refund the full purchase amount within 14 days.
8.5 An exception to the right of withdrawal applies to products subject to price fluctuations in financial markets, over which the seller has no influence. This applies especially to gold and silver coins, whose value is largely determined by the metal value.
8.6 Such products cannot be returned or canceled after purchase, in accordance with Article 6:230p sub a of the Dutch Civil Code.

Article 9: Exchange and Returns (for Non-Consumers)
9.1 Exchange or return is not possible for business buyers unless otherwise agreed in writing.

Article 10: Liability
10.1 J. van Dam Numismatics is not liable for any direct or indirect damages unless there is intent or gross negligence.
10.2 The seller’s liability is in all cases limited to the amount of the purchase in question.
10.3 Coins are sold as described in the product descriptions, with any defects or specifications indicated in advance or visible to the buyer through images or in person. The buyer must inspect the products upon delivery and immediately report any complaints.

Article 11: Retention of Ownership
11.1 All delivered coins remain the property of J. van Dam Numismatics until the buyer has fully met their payment obligations.

Article 12: Applicable Law and Disputes
12.1 Dutch law exclusively applies to all agreements between J. van Dam Numismatics and the buyer.
12.2 Disputes between the parties will be submitted to the competent court in the district where the seller is located, unless mandatory law prescribes otherwise.

Article 13: Privacy and Data Protection
13.1 J. van Dam Numismatics processes personal data in accordance with the General Data Protection Regulation (GDPR). Personal data is only used for the execution of the agreement and will not be shared with third parties without consent, unless necessary for the execution of the agreement (e.g., for shipping).
13.2 The buyer has the right to access, correct, and delete their personal data as stipulated by the GDPR.

Article 14: Liability for Information and Use
14.1 J. van Dam Numismatics strives to present all information on the website and other provided information as accurately as possible. However, J. van Dam Numismatics cannot be held liable for any damages resulting from incorrect use or misinterpretation of the provided information.
14.2 The buyer is always responsible for the correct interpretation and use of the information, in accordance with Article 6:101 of the Dutch Civil Code (contributory negligence). J. van Dam Numismatics cannot be held liable for indirect, consequential, or any form of damages arising from misinterpretation of the provided data.

Article 15: Intellectual Property and Use of Visual Material
15.1 All images, photos, and other visual materials provided by J. van Dam Numismatics on the website, in catalogs, or through other communication channels are the property of J. van Dam Numismatics and are protected by copyright law (Article 1 of the Dutch Copyright Act of 1912).
15.2 It is not permitted for third parties to copy, distribute, publish, or use this visual material in any way without prior written permission from J. van Dam Numismatics, regardless of the intended use.
15.3 Violation of this article may result in legal action, including claims for damages and/or an injunction to cease infringing activities.
