Article 1 - Legal Notice

 

The purpose of the present terms and conditions is to define the terms and conditions of use of the services and products offered on the Fine Art Numismatics boutique of the Fine Art Collections simplified joint stock company, as well as the obligations of the parties in this context.

 

They apply to all sales of coins, medals, tokens, collector's tickets or other items concluded via the boutique.

 

This distance selling service is operated by Fine Art Collections, a one-person simplified joint stock company with capital of €5,000.00, registered in the Rouen Trade and Companies Register under number 921 411 799, with its registered office at 16 rue Porte aux Rats 76000 Rouen.

Article 2 - General Provisions Relating to these Terms and Conditions

 

The General Terms and Conditions of Sale (GTCS) apply exclusively to the online sale of products offered by Fine Art Collections in the Shop. The terms and conditions applicable at the time of sale are those validated when the Product is ordered.

 

The GCS are made available to Users on the Shop, where they can be consulted directly, and can also be communicated to Users on request by any means of exchange.

 

The General Terms and Conditions of Sale are binding on the Customer, who acknowledges having read and accepted them before placing an order, by clicking on the appropriate button or by ticking a box. Validation of the order by its confirmation implies acceptance by the purchaser of the GCS in force on the day of the order, which are kept and reproduced by the Operator.

 

The Operator reserves the right to modify the General Sales Conditions at any time.

Article 3 - Prices, Nature and Description of Products

 

Fine Art Numismatics is an online store selling collectibles, coins, banknotes, medals, tokens, monetary weights, and any other collectible item related to Numismatics.

 

Pricing of Products is at the sole discretion of the Operator. In the case of promotional offers or discount vouchers, these have a limited validity and application according to the terms and conditions exclusively provided by the Operator. Any other offer proposed by the Operator on a Product is a private exchange between the Operator and the Customer. This offer is firm and legal only when the Operator issues an invoice for the Product concerned, and when this invoice is communicated to the Customer. 

 

With the exceptions listed above, all Product prices are fixed prices, expressed in Euros, inclusive of all taxes. These Prices are convertible on request into other currencies, according to the legal rate in force at the time of the request. The Prices indicated on the Product sheets are all exclusive of delivery charges. Delivery costs are indicated as an additional charge when ordering a Product. They may vary according to the Product concerned and the delivery service applied. For further details, the Customer should refer to the “Delivery” section of these General Terms and Conditions of Sale. 

Any change in the Price of a Product is the sole responsibility of the Operator. It may be of a temporary or permanent nature; it may be linked to internal or external contingencies, new expertise, or any other factor that the Operator deems relevant to re-evaluate the Product. Consequently, the Operator reserves the right to respond to any request concerning a possible variation in the Price of a Product.

 

The Products presented on the store are each the subject of a description (drawn up by the Operator) mentioning their essential characteristics. Any photographs or scans illustrating the Products do not constitute a contractual document. Before placing an order, the Customer may request photographs or additional information about a Product. The Products comply with current French and European legislation.

 

Despite the expertise and care taken by the Operator to provide the most accurate information possible concerning the Products, in the event of an error noted by the Customer, the latter is invited to report any relevant information concerning the Product to the Operator. The Operator reserves the right to take this information into account or not, in order to modify the Product sheet.

Article 4 - Liability and Warranty

Fine Art Collections guarantees the authenticity of every item sold on its online boutique. Before any item is put up for sale, it is appraised to ensure its authenticity. Should an item prove to be a fake, despite the care taken in the authentication process, it will be immediately withdrawn from the sale. 

The Operator Fine Art Collections, as a legal entity, is responsible for the information given to the Customer concerning the Product. It is also responsible for the delivery of the Product purchased by the customer.

 

The User, using the Site, remains responsible for the modalities and consequences of his/her access to the Site, notably via the Internet. Such access may involve the payment of fees to technical service providers such as Internet access providers, which remain at the User's expense. In addition, the User must provide and be entirely responsible for the equipment required to connect to the Site (login and password).

 

The User acknowledges that he/she has checked that the computer configuration he/she is using is secure and in working order.

Article 5 - Orders
 
The Operator endeavours to guarantee optimal availability of its Products. Product offers are subject to availability.
 
If, despite the best efforts of the Operator, a Product proves to be unavailable subsequent to the Customer's order, the Operator will inform the Customer by email as soon as possible and the Customer will have the choice between:
 
delivery of a Product of equivalent quality and price to the one initially ordered, and this only with the Customer's agreement
reimbursement of the price of the Product ordered within 30 days of payment of the sums already paid.
It is agreed that apart from reimbursement of the price of the unavailable Product, if this option is requested by the Customer, the Operator is not liable for any cancellation indemnity, unless the non-performance of the contract is personally attributable to the Operator.
 
With the exception of any mention to the contrary in these General Terms and Conditions, and without prejudice to the right of withdrawal provided for by applicable law, the Customer's orders are firm and final.
 
When placing an order, the Customer must select the Products chosen and add them to his/her basket, indicating the Products selected and the quantities desired. The Customer may check the details of his order and its total price, and return to the previous pages to correct the contents of his basket if necessary, before validating it.
 
The Customer undertakes to read the General Terms and Conditions of Sale in force at the time before accepting them, and to confirm the terms and conditions and any delivery and withdrawal charges prior to payment of the order. Confirmation of the order implies acceptance of the GCS and forms the contract.
 
Contractual information relating to the order (such as the order number) will be confirmed by e-mail in due course and at the latest at the time of delivery. The Operator strongly advises the customer to print and/or archive this order confirmation on a reliable and durable medium as proof. A digital invoice is available to the customer in the “Personal Account” area. The Operator also advises the Customer to print and/or archive this invoice on a reliable and durable medium as proof.
 
Any e-mail sent to the customer in connection with an order will be sent to the e-mail address used by the customer to log in to the customer area.
 
The Operator reserves the right not to validate the Customer's order for any legitimate reason, in particular if:
 
the customer does not comply with the General Terms and Conditions in force at the time of ordering;
one of the Customer's previous orders is the subject of a dispute currently being processed;
the Customer's order history shows that there are outstanding sums from previous orders;
The customer has not responded to a request for order confirmation sent by the Operator.
The Operator archives contracts for the sale of Products in accordance with applicable legislation. By sending a request to the following address contact@fineartnumismatics.com, the Operator will provide the Customer with a copy of the contract which is the subject of the request.
 
Any modification of the order by the Customer after confirmation of the order is subject to the agreement of the Operator.
 
The information provided by the customer when placing the order (in particular name and delivery address) is binding. The Operator cannot be held responsible in the event that an error in placing the order prevents or delays delivery.
 
The Customer declares that he/she has full legal capacity to enter into the present General Terms and Conditions.
 
Registration is open to adults of legal age and to minors, provided that they are acting under the supervision of a parent or guardian with parental authority. Under no circumstances is registration authorized on behalf of a third party unless the third party is validly authorized to represent it (e.g. a legal entity). Registration is strictly personal to each Customer.
 
In the event of a breach by the Customer of any of the provisions herein, the Operator reserves the right to terminate the Customer's account without notice.
 
Article 6 - Terms of payment 
 
Fine Art Collections uses the online payment solution.
 
Several methods of payment may be used to pay for orders:
 
By bank transfer, payment is made online via the company's bank's secure servers. Bank details are protected by SSL encryption, and are therefore not accessible either on the site or to third parties.
 
Once payment has been accepted by the bank, the customer's order is recorded.
 
The customer may also pay by Paypal, without having to provide bank details. 
 
In the event of payment by cheque, the Customer must send the cheque to the Operator within two weeks of validation of the order. The Operator will only be able to deliver the Product once the amounts due have been received in the Operator's bank account.
 
Article 7 - Delivery and Export
 
When the Customer places an order for a Product, the Operator offers several delivery options:
 
Delivery by La Poste in the form of a tracked letter, distributed in France within a minimum indicative period of two days.
Delivery by registered mail, distributed by the French Post Office within a minimum indicative period of three days. 
In the event of a specific request from the customer for delivery in France or abroad, the latter is invited to contact the Operator, by e-mail or telephone, so that a solution can be found. The Operator may also use the services of private carriers. The cost of delivery is then determined by the Operator, who will inform the Customer before the sale is concluded.
 
For any Product whose order is validated by the Customer, the Operator undertakes to dispatch the Product within two working days following the date of effective receipt of payment.
 
The Customer will be notified in advance of any absence of the Operator, so that the Customer is aware of any delays that this absence may cause prior to ordering a Product.
 
In accordance with the legal provisions of Article R.621-98 of the French Heritage Code, all coins dating from before 1500, and valued at 3,000 euros or more, must apply for an export certificate if sold abroad, and for an export license if taken out of the European Union. This rule also applies to all coins over one hundred years old, post-dating 1500, whose value is equal to or greater than 15,000 euros.
 
For all coins meeting these criteria, French legislation on the protection of cultural property requires the seller to obtain an export certificate, which must be applied for from the French Ministry of Culture. The time required to obtain these documents varies - a minimum of 4 to 6 weeks - and Fine Art Collections cannot be held responsible for delays in delivery due to delays in the issue of administrative documents by the French Ministry of Culture. All certificates are valid for an unlimited period.
 
Article 8 - Right of withdrawal
 
In accordance with article L 121-20 of the French Consumer Code, the Customer has a period of 30 days from receipt of the Product to request an exchange or refund of the Product. The request can be made by e-mail or registered letter so that it can be taken into account as soon as possible by the Operator.
 
In the event of a return, the Customer must return the Product in the same condition and in the same state as the Product received. The characteristics of the Product must therefore correspond to those indicated and photographed on the Product's item sheet. 
 
Any Product returned damaged or modified by the Customer will not be reimbursed by the Operator.
 
In the event of a return due to deterioration of the Product following its delivery, the Operator undertakes to refund the Product or to replace it, depending on the availability of the Product and the Customer's request. 
 
Article 9 - Consumer mediation
 
In accordance with the provisions of articles L 611-1 and R 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator. The mediator must be contacted within one year of the initial complaint.

Article 10 - Intellectual property
 
In accordance with the provisions of the intellectual property code, only personal use is authorized of all photos, images, brands, as well as all logos, texts, files and other elements of intellectual property visible on the Operator's store.
 
The Fine Art Numismatics brand is the sole property of the Operator. It is a trademark registered with the INPI, protected by law, the use of which is exclusive to the Operator.
 
Article 11 - Personal data
 
Fine Art Collections undertakes not to divulge to third parties any information that you may communicate to us. This information is confidential. It will only be used for commercial purposes, i.e. between the site user and its manager. The surnames, first names, addresses and telephone numbers communicated are used solely to process your order and to personalize communication with Fine Art Collections customers.
 
You have the right to access, rectify and object to any personal data concerning you at any time, by simple request online or by post, to the contact details given above, and without any justification being required.
 
Article 12 - General provisions
 
The present contract is subject to French law. The language of the present contract is English. 
 
All disputes arising from this contract shall be referred to the Rouen Commercial Court, which shall have sole jurisdiction.
